Global capability centres, BPOs, warehouses, hospitals, data centres and manufacturing plants increasingly run 24x7. Many of them want more women in their workforce, including on evening and night shifts. India's labour framework allows this, but only with the right consent, safety and welfare conditions in place. For employers, getting it right is both a compliance requirement and a powerful hiring advantage. This GRPL India guide sets out a practical approach for 2026.
What the Law Expects
Under the Occupational Safety, Health and Working Conditions Code, women may be employed in all types of establishments, including at night, subject to their consent and to conditions on safety, holidays, working hours and other matters that the appropriate government may prescribe. State Shops and Establishments rules and factory permissions often add specific conditions such as transport, security and minimum numbers on a shift. Always check the current rules in each state where you operate and follow updates from the Ministry of Labour & Employment.
Consent Done Properly
- Take written, voluntary consent for night work; never make it a hidden condition of employment.
- Allow women to opt out later with reasonable notice, without penalty.
- Explain shift timings, rotation and allowances clearly at offer stage.
Safe Transport: The Non-Negotiable
Most incidents happen in transit, not at the workplace. Provide door-to-door company transport for night shifts, with verified drivers and vehicles fitted with GPS tracking. Plan routes so that, where possible, a woman employee is not the first pick-up or last drop alone; where that cannot be avoided, add a trained security escort. Maintain a live transport desk and an emergency helpline, and record every trip.
Workplace Safety and Welfare
- Well-lit premises, parking areas and pathways, with CCTV coverage.
- Women security staff on night shifts and a supervisor available on site.
- Rest rooms, clean washrooms and access to food and drinking water.
- Medical support and a first-aid trained person on every shift.
POSH Compliance Is Part of the System
The Sexual Harassment of Women at Workplace Act requires an Internal Committee in organisations with ten or more employees, awareness sessions and a clear complaint process. Night-shift workers must have the same access to the committee as day staff. The Ministry of Women and Child Development publishes guidance and the SHe-Box portal for complaints.
Building a Strong Pipeline of Women Talent
Women candidates ask direct questions about transport, security and flexibility. Answer them in job descriptions and at interviews. Offer predictable rosters, shift swaps, career progression to team lead roles, and returnship programmes for women restarting careers. Make sure PF through EPFO and ESI through ESIC cover everyone, including those on a staffing partner's payroll.
An Employer Checklist
- Written night-work policy approved by leadership and reviewed by counsel.
- State permissions and registrations in place for each site.
- Transport contract with driver verification and GPS audits.
- Security, CCTV and emergency response tested monthly.
- Internal Committee constituted and trained; posters and helplines displayed.
- Quarterly feedback from women employees on safety and comfort.
