A GRPL India client forwarded a month-end salary Excel to five managers "for visibility". One laptop was stolen from a car the same week. Nothing exotic—just bank accounts, net pay in INR and personal mobiles in a single sheet. The Digital Personal Data Protection Act made the conversation board-level overnight. GRPL India helped them move payslips to an authenticated channel and lock payroll exports to two named admins.
Why HR and Payroll Are Now Data-Fiduciary Work
Indian employers already held salary bank details, Aadhaar references for KYC, UAN numbers, medical declarations and family data. The Digital Personal Data Protection Act, 2023 raises the bar on purpose limitation, security safeguards and retention discipline for that stack. HR teams that treat spreadsheets as casual storage now carry board-level risk when a payslip file leaks or a vendor forwards an unencrypted employee dump.
This checklist is an employer operations brief, not legal advice. Read the Act and rules with counsel, and keep statutory employment obligations under the Ministry of Labour & Employment framework aligned with privacy decisions so you do not delete records you are required to keep.
Personal Data That Lives Inside Payroll
- Identity and KYC artefacts used for EPFO and ESIC onboarding.
- Bank account numbers printed on payslips and exported to payment files.
- Salary structures, reimbursements and tax declarations feeding Income Tax India TDS workings.
- Attendance biometrics or device logs that explain wage calculations.
- Exit documents that still contain contact and account details months later.
1. Name a purpose for every field
If a column in the employee master has no hiring, wage, statutory or security purpose, stop collecting it. Purpose creep is how HR folders become breach magnets.
2. Minimise Aadhaar handling
Collect and display Aadhaar-linked data only where a lawful process requires it, mask numbers in shared views and never paste full IDs into email threads or open WhatsApp groups.
3. Lock UAN and bank exports
Payment files and UAN bulk uploads should move through access-controlled folders with named owners, not personal inboxes.
We now ask hiring and payroll stakeholders the same opening question: who can download the employee master today, and why? If the answer is "everyone in HR", the fiduciary checklist starts there.
Fiduciary Checklist for HR and Payroll Teams
- Inventory: list systems that store employee personal data—HRMS, payroll, email, shared drives, staffing vendor portals.
- Access: role-based rights; remove leavers from payroll admin groups the same day.
- Vendor contracts: staffing and payroll processors must spell out security, breach notice and deletion or return of data in INR-scoped agreements.
- Payslip channels: prefer authenticated employee portals over bulk PDF dumps on open drives.
- Retention: keep what labour, tax and PF rules require; delete or archive-with-restriction what they do not.
- Breach drill: write who calls whom if a salary file is mis-sent.
One Group, Five Specialist Hiring Desks
GRPL India is part of Galaxy Resource Pvt Ltd, and when candidate data and payroll data both flow through hiring partners, we do not work alone. Optistaff Solutions Private Limited runs contract staffing, payroll and compliance-heavy deployments; Bharti HR handles high-volume, walk-in and direct-joining hiring from Lucknow; Zeevika Consultancy supports specialist and consultancy-led searches; and Naukri Hunter widens the candidate funnel through its job-seeker community. Openings are also published on JobGetway, the group's job portal, so a single brief from you reaches several talent pools on day one.
Hiring Channels and Candidate Data
Recruitment teams pull resumes from the government National Career Service (NCS) portal, JobGetway, LinkedIn Jobs and Indeed India. Apply the same minimisation rules to candidates: take only what shortlisting needs, avoid forwarding full CV packs to every manager, and erase rejected-applicant data on a published schedule unless a lawful dispute hold applies.
Never charge candidates any fee, and never ask them to share OTPs or full Aadhaar PDFs over unofficial chat as a condition of interview.
Balancing Privacy With Statutory Proof
Privacy is not a reason to skip PF or ESI proof. Principal employers still need challan evidence from contractors via EPFO and ESIC portals. Share the minimum necessary extracts, watermark internal copies and store them in a restricted compliance library. Tax teams preparing Form 16 packages should follow Income Tax India guidance without emailing entire employee databases to personal IDs.
Across the Galaxy Resource group we treat candidate databases and payroll files as high-risk assets, with access logs and vendor clauses that match the sensitivity of the data.
A 30-Day DPDP Hygiene Sprint for SMEs
Days 1–7: inventory systems and name data owners.
Days 8–14: mask Aadhaar and bank fields in non-payroll views; close open shared links.
Days 15–21: update vendor clauses and collect security confirmations.
Days 22–30: run a misdirected-payslip tabletop drill and fix gaps.
Global decent-work and responsible-business discussions at the International Labour Organization level reinforce the same idea Indian boards now hear locally: people data deserves governance, not improvisation.
Payslip, Bank File and UAN Handling Standards
Publish an internal standard: payslips go through an authenticated channel; bank payment files live in a restricted folder with two-person access; UAN bulk templates are generated from the HRMS, not from a personal desktop copy. Mask account numbers in screenshots used for training. When managers need cost reports, give aggregated INR figures without employee-level bank fields.
Onboarding packets should separate statutory KYC fields for EPFO and ESIC from nice-to-have profile data. Candidates sourced via the government National Career Service (NCS) portal, JobGetway, LinkedIn Jobs and Indeed India deserve the same minimisation you give employees—collect once, store once, share narrowly.
Vendor and Cross-Border Reality Checks
Staffing vendors, background-check firms and payroll processors are processors of your people data. Flow-down security clauses, audit rights and breach timelines. If a foreign parent requests Indian employee data, involve counsel on transfer conditions rather than emailing raw HRIS extracts.
Keep labour registers required under Ministry of Labour & Employment guidance even while you delete surplus marketing copies of resumes. Privacy and statutory retention are twin rails, not opposites. Income Tax India Form 16 packages likewise need controlled distribution lists.
Many SMEs discover that a single shared inbox named hr@company becomes an ungoverned archive of Aadhaar images—fix the inbox, migrate needed files, and shut open links within the 30-day sprint.
Document your decisions. A one-page data map naming systems, owners, retention periods and vendor contacts is often enough for an SME board pack. Update it when you add an HRMS module or change staffing partners, and store it beside your Ministry of Labour & Employment compliance folder—not in a forgotten chat thread.
Training Managers Without Scaring Them
Run a thirty-minute briefing: what not to forward, how to request salary data, how to report a suspected leak. Give managers a safe path to ask payroll for numbers without receiving the whole bank file. Reinforce that hiring through the government National Career Service (NCS) portal, JobGetway, LinkedIn Jobs and Indeed India still requires CV care. Keep examples in INR cost-of-breach language your board understands—discuss incident-response retainers with counsel rather than guessing figures in a blog.
Frequently Asked Questions
Can we keep employee data forever because PF might ask later?
Keep what applicable law and your advisor say you must retain, with access limits. Forever-open folders for every intern CV are not a retention strategy.
Are WhatsApp salary slips compliant?
Unofficial chat is a common leak path. Prefer authenticated portals or controlled email to the employee's registered address, with clear INR figures and no extra KYC attachments.
Does DPDP replace POSH or labour registers?
No. Privacy duties sit beside labour, tax and social-security duties. Use the Ministry of Labour & Employment resources for employment law direction and privacy counsel for DPDP interpretation.
