Every growing business in India eventually faces the same question: should this role be a permanent hire on your payroll, or should it be filled through contract staffing via a manpower partner? Get it right and you control costs while keeping quality. Get it wrong and you either carry idle headcount through a slow quarter or keep re-training temporary workers for work that never actually ends.
The answer has also changed since the four Labour Codes came into force on 21 November 2025. This guide compares both models honestly, explains what the new rules mean for each, and gives a simple decision checklist. It draws on staffing mandates handled by Galaxy Resource Pvt Ltd (GRPL India) and its group companies across manufacturing, warehousing, retail, BPO and field sales.
What Each Model Really Means
- Permanent hire: the person is your employee from day one. You run payroll, statutory contributions, appraisals and exits.
- Contract staffing (third-party): a staffing company employs the worker and deploys them at your site. The staffing firm handles payroll, PF, ESI and documentation; you, as principal employer, direct the daily work and remain responsible for certain welfare obligations.
- Fixed-term employment (FTE): a middle path — your own employee, hired directly for a defined period or project.
When Contract Staffing Wins
- Seasonal or peak demand: festive-season warehousing, harvest-linked processing, year-end sales pushes. Volumes rise for 8–16 weeks and then fall.
- New locations or pilots: you are testing a new city or product line and do not want to commit permanent headcount until it proves itself.
- Volume roles with high churn: pickers, packers, loaders, delivery partners and telecalling teams, where replacing people quickly matters more than individual tenure.
- Limited HR bandwidth: a 40-person company cannot run onboarding, compliance and payroll for 60 extra workers. A staffing partner can.
- Speed: an established manpower supplier already has a bench and can deploy within days.
When Permanent Hiring Wins
- Core, knowledge-heavy roles: accounts, plant quality, key account sales, HR — roles where context builds over years.
- Customer-facing continuity: if clients expect the same face every month, churn costs you relationships.
- Leadership and succession: supervisors and managers must be developed, not rented.
- Confidential or regulated work: finance, legal, data-sensitive processes.
- Steady, year-round workload: if the "temporary" need has lasted 18 months, it is permanent.
The Real Cost Comparison
Contract staffing often looks more expensive because the invoice includes a service fee on top of wages. But compare the full picture:
- Permanent cost: salary + employer PF and ESI + gratuity provision + leave + recruitment cost + HR admin time + cost of a wrong hire.
- Contract cost: wages + statutory contributions + service fee — with replacement, payroll and compliance handled by the partner.
For short or volatile demand, contract staffing usually comes out cheaper overall. For stable, skilled roles held longer than a year or two, permanent hiring usually wins.
What the Labour Codes Changed
The Government's announcement of the four Labour Codes consolidated 29 older labour laws. Points that matter for this decision:
- Fixed-term employees get the same wages and benefits as permanent staff doing similar work, and become eligible for gratuity after one year of service instead of five.
- Contract workers: the principal employer must ensure health and social security benefits reach contract workers, so choosing a compliant partner is no longer optional.
- Uniform wage definition: allowances above 50% of total pay are added back to "wages" for PF, gratuity and other statutory calculations, which affects cost models for both permanent and contract staff.
- Appointment letters are now mandatory for every employee.
Read the official text and FAQs on the Ministry of Labour and Employment website, and verify that your vendor's PF and ESI deposits actually reach workers' accounts through EPFO and ESIC challans. Our companion guide on Labour Codes HR compliance covers the full checklist.
A Quick Decision Checklist
For each role, answer yes or no:
- Will the workload last more than 12 months at the same level?
- Does the role need more than three months to become fully productive?
- Does it hold client relationships, confidential data or statutory sign-off?
- Do we have HR capacity to recruit, onboard and manage these people ourselves?
Three or four "yes" answers: hire permanent (or fixed-term with a conversion path). Zero to two: contract staffing is likely the smarter option. Many companies end up with a core-plus-flex model — a permanent core team with a contract layer that expands and contracts with demand.
How to Choose a Staffing Partner
- Ask for proof of PF and ESI registration and sample monthly challans.
- Agree replacement timelines in writing (for example, within 72 hours).
- Insist on documented background checks before deployment.
- Check that workers receive payslips and appointment letters.
- Review attendance, attrition and replacement data every month.
