Using AI Resume Screening Responsibly: Candidate Data Privacy and Fair Hiring Under India's DPDP Act for Employers

Indian and global employers: use AI resume screening fairly and protect candidate data under the DPDP Act with consent, retention, bias checks and human review.

Using AI Resume Screening Responsibly: Candidate Data Privacy and Fair Hiring Under India's DPDP Act for Employers

AI tools now read resumes, rank applicants and even schedule interviews for many Indian employers and global capability centres. Used well, they cut time-to-hire and help recruiters handle thousands of applications. Used carelessly, they can reject good candidates unfairly and expose personal data. With India's Digital Personal Data Protection (DPDP) Act and its rules shaping how personal data is handled, HR teams need a clear playbook. This GRPL India guide explains how to use AI screening responsibly.

What Candidate Data You Actually Hold

A single application can include name, phone, email, address, date of birth, education, employment history, salary, photographs and sometimes ID numbers. All of this is personal data. Review the Digital Personal Data Protection framework at MeitY and treat recruitment data with the same care as payroll records.

Five Principles for Privacy-Safe Recruitment

  1. Clear notice and consent: tell applicants what data you collect, why, which tools process it and how long you keep it.
  2. Collect only what you need: do not ask for Aadhaar, family details or photographs at the application stage unless the role legally requires them.
  3. Limit retention: delete or anonymise unsuccessful applications after a defined period, and tell candidates how to request deletion.
  4. Secure vendors: sign data processing terms with your ATS, AI screening and assessment vendors, including breach notification.
  5. Respond to rights requests: assign an owner for candidate questions about access, correction or deletion.

Keeping AI Screening Fair

  • Audit outcomes: compare shortlist rates across gender, location and college tier every quarter.
  • Remove proxies: exclude photos, names, age and home address from scoring wherever possible.
  • Use job-related criteria: score against skills and experience from the job description, not vague culture fit.
  • Keep a human in the loop: a recruiter should review borderline rejections and every final decision.
  • Explain decisions: be ready to tell a candidate, in plain words, why they were not shortlisted.

The ILO Fair Recruitment Initiative principles on fair recruitment also apply to digital hiring. Equality and non-discrimination expectations from the Ministry of Labour & Employment do not disappear because a tool made the first cut.

A 30-Day Action Plan for HR Teams

Week one, map every place candidate data flows, from job portals such as LinkedIn Jobs, Indeed India and the National Career Service (NCS) portal to email inboxes and spreadsheets. Week two, update your career page privacy notice and application forms. Week three, review vendor contracts and access rights. Week four, run your first bias audit and train recruiters on the new process.
